Revised Clean Copy of Final Temperature Regulation

Proposed Changes to the Colorado Temperature Regulation

The Water Quality Control Division (“Division”), serving as staff to the Water Quality Control Commission (“Commission”), is providing a revised proposal and supporting information for consideration in the hearing to modify certain sections of the Basic Standards and Methodologies for Surface Water, Regulation No. 31 (“Basic Standards”) and corresponding revisions to the Classifications and Numeric Standards for each of the river basins in Colorado (Regulation Nos. 32, 33, 34, 35, 36, 37 & 38). 

WQCD Proposal and Exhibits

Exhibit 1 Revisions to the Proposal and Statement of Basis. This reflects revisions that are the result of multiple meetings with stakeholders as well as continued work to augment the Colorado Temperature Database.
Exhibit 2 Electronic copy of the version 2 of the Colorado Temperature Database and queries. A CD that contains the database has been submitted to the Commission office and copies have been emailed to Parties to the hearing.
Exhibit 3 Electronic copies of the version 2 MS Excel worksheets used to calculate table values presented in the Prehearing Statement. A CD that contains the spreadsheets along with the database has been submitted to the Commission office and copies have been emailed to Parties to the hearing.
Exhibit 4 Water Quality Control Commission Policy 2006-1
Exhibit 5 Basis for Table Value Criteria and Explanation of 2006 Temperature Database. This includes a discussion of changes between the Notice version and the Prehearing statement version.
Exhibit 6 Basis for “Normal” Provisions of the Temperature Standard. This includes the evidence in support of the Division’s proposal for normal pattern of seasonal fluctuation, summertime diurnal fluctuations, spatial diversity, prohibition of abrupt changes, and protection of critical reproductive season
